$54 Million for Minnesota Farmers.

Minnesota Farmers were part of a Federal Court class action that produced a settlement against Chubb Insurance of $54 million dollars. Douglas E. Schmidt, the Senior Trial Lawyer at the Schmidt Law Firm, Minneapolis Accident Attorneys, has 30 years experience in over 6,000 successful case in personal injury and wrongful death cases. These cases involved car accidents, trucking accidents, construction site accidents, boating accidents, medical malpractice and a wide range of other injury and wrongful death claims.

His experience also extends to cases other that personal injury’s record of bringing justice to MINNESOTA FARMERS who have suffered economic losses. Schmidt was successful in bringing justice to a group of Midwest farmers, many from Minnesota, who suffered economic losses in a class-action lawsuit involving the fraudulent sale of “rain insurance”.

Chubb insurance company, which is one of the major insurance companies in the United States, had sold hundreds of policies of “rain insurance” to the farmers. However, Chubb waited an unreasonable period of time before exercising the clause in the insurance application which purported to allow it to reject these applications. Chubb waited to see if that would rain before deciding to accept coverage. This was simply a “win-win” for Chubb, as it played the game.

Schmidt was appointed by the U.S. District Court Judge in Cincinnati, Ohio as one of State Counsel for the farmers. The case resulted in a $54 million settlement in favor of the farmers.

The Schmidt Law Firm, MINNEAPOLIS ACCIDENT ATTORNEY, brought justice for a Minnesota dairy farmer in yet another case. A Nobles County, Minnesota jury returned a verdict which resulted in a total recovery for the farmer of approximately $1.4 million dollars in a FARM ECONOMIC LOSS CLAIM.

This result came after over 2 years of a hard-fought battle against a drug manufacturing company which involved a 3 week trial in Worthington, Minnesota.

The case involved a defective vaccine which was being used by the farmer to vaccinate his dairy cows. It was supposed to contain “killed” germs. Instead, it contained live germs that were actually infecting his cows instead of inoculating them against disease. This was essentially a PRODUCTS LIABILITY CLAIM which involved DEFECTIVE VACCINE.p>

$2.4 million Jury Verdict in MINNESOTA MEDICAL MALPRACTICE CLAIM.

A jury returned a verdict of $2.4 million for a Jordan, Minnesota woman for injuries sustained by her during a gall bladder surgery at St. Francis Hospital in SHAKOPEE, MINNESOTA. She was represented by attorney Douglas E. Schmidt of the Schmidt law firm, MINNEAPOLIS ACCIDENT ATTORNEY.

This is believed to be the largest jury verdict in a PERSONAL INJURY CLAIM in SCOTT COUNTY, MINNESOTA. It is also believed to be one of the largest for injuries of that nature.

The woman’s injuries were suffered during a gall bladder surgery (cholecystectomy). The surgery was successfully completed. At the conclusion, the doctor attempted to insert a central venous catheter (CVC) line. Complications occurred when the surgeon had difficulty inserting the line and pierced an artery in doing so. The patient developed stroke-like symptoms which were first observed in the post-operative recovery period.

The case was fiercely defending and went all the way to a jury decision. The jury ruled in favor of Schmidt’s client, apparently finding medical negligence in both the improper insertion of the CVC line and also the failure to provide appropriate treatment in response to the post-surgical problems that developed.

Schmidt observed that “In order to describe a force of the highest degree, people will say that it was like getting hit with a Mack truck. My client did get hit by a Mack truck.”

$900,000 Court Award in MINNESOTA FARM INJURY CLAIM.

After a hard-fought trial, another record recovery was obtained by the Schmidt Law Firm, MINNESOTA FARM ACCIDENT LAWYER, in a lawsuit that involved injuries to a McLeod county, Minnesota farmer who suffered the amputation of his hand in a farm equipment accident.

Schmidt’s client owned the machine in partnership with another farmer. The co-owner of the machine improperly filled the machine with diesel fuel which used gasoline. As the result, the machine malfunctioned and the engine heated up. When Schmidt’s client attempted to investigate, he opened the engine compartment and was sprayed with hot radiator fluid. He reacted, lost his balance and his hand went into the radiator fan. As a result, he suffered major injury to his hand which required amputation.

The case went to trial in McLeod County and was tried to conclusion before a judge who ruled in favor of Schmidt’s client. The recovery was paid by the FARM LIABILITY INSURANCE company for Schmidt’s client’s partner.

$300,000 for Man Injured in ATV RECREATIONAL VEHICLE ACCIDENT.

The Schmidt Law Firm, Minneapolis Accident Attorney, recently successfully concluded a case involving leg injuries suffered by a Savage, Minnesota man who was injured in a one-vehicle all terrain vehicle (ATV) accident.

The accident occurred in northern Minnesota. Schmidt’s client was visiting friends whose family had a cabin in the North Woods. The client was riding as a passenger on an ATV which was traversing a dirt trail which was very slippery because of a recent rain. As they were traversing a steep incline and attempting to negotiate a sharp curve, the ATV went out of control and slammed into a tree. Schmidt’s client’s leg was injured when it was pinned between the side of the machine and the tree.

$250,000 for Bicycle Rider Hit by Truck in ST. PAUL BICYCLE TRUCK ACCIDENT.

Douglas E. Schmidt of the Schmidt Law Firm, ST. PAUL BICYCLE ACCIDENT ATTORNEY, recently negotiated a successful settlement for a St. Paul, Minnesota woman who was hit by a SEMI-TRUCK as she was riding her bicycle at an intersection in St. Paul. She was, at the time, crossing at a cross walk. As she did so, she passed in front of a U.S. Postal Service semi-truck. The trucker was in the process of attempting to make a right turn on a red light and did not see Schmidt’s client. As a consequence, her bicycle was knocked over and she was pushed along the pavement before onlookers alerted the truck driver’s attention to the problem.

The client sustained injuries to her leg which required skin grafting.

The case was a difficult one for many reasons. Principal among them was the fact that the claim was against the U.S. government and had to be brought under the FEDERAL TORT CLAIMS ACT which forbids the filing of any lawsuit without first going through the process required by the Act.

Schmidt’s client had no MINNESOTA NO FAULT INSURANCE. Because the truck was owned by the U.S. government, it did not have No Fault insurance.

Despite these and many other obstacles, Schmidt successfully negotiated a settlement without having to take the case to court.

$600,000 for Zamboni Lung Injuries in COON RAPIDS MINNESOTA INJURY CASE.

The Schmidt Law Firm, Minneapolis Accident Lawyer, has a wonderful reputation for handling difficult and challenging personal injury and wrongful death cases. Douglas E. Schmidt, the senior trial lawyer at the Schmidt Law Firm, Minneapolis Accident Attorney, has handled many complicated and difficult product liability and medical malpractice claims.

One of the most challenging of this cases was that in which Douglas E. Schmidt successfully represented some 43 victims of lung injury caused by a defective Zamboni ice-resurfacing machine at the Jay Cook Ice Arena in Coon Rapids, Minnesota. The victims were hockey players, hockey coaches, hockey team cheerleaders and spectators.

These injuries occurred as the combination of three major problems. First, the Zamboni was fueled by propane and its carburetion was improperly adjusted so that it was emitting nitrogen dioxide, a gas that can cause serious damage to lung tissue when inhaled.

Secondly, the personnel of the ice arena was violating State law which required testing of the air quality on the regular basis.

Thirdly, the personnel of the ice arena had shut down the arena’s ventilation system, also in violation of State law.

The City of Coon Rapids refused to offer fair settlements to the victims and Schmidt took five of these cases to a jury trial and won all five, obtaining jury verdicts of approximately $400,000. The remainder of the cases successfully settled after these trials.

The Schmidt Law Firm, Minneapolis Accident Lawyer, has over 30 years experience in over 6,000 successful cases involving personal injury and wrongful death.

$1 Million Jury Verdict in MINNESOTA MEDICAL MALPRACTICE CASE against MAYO CLINIC.

One of the outstanding results of Douglas E. Schmidt involved a $1 million jury verdict in a medical malpractice case against Mayo Clinic. The result came after a very hard fought trial in U.S. District Court in Minneapolis.

Schmidt’s client suffered a loss of vision after having surgery to correct a nerve condition in his face.

Schmidt’s client has this to say about his lawyer, Doug Schmidt:

“With tireless effort, with single-minded determination, and with uncompromised loyalty, you battled one of our nation’s most powerful institutions, as well as their lawyers from Minnesota’s largest firm. (They) threw all they had against us. They didn’t think they could be out-worked, out-classed, and out-lawyered. What their resources couldn’t beat was the power of one lawyer with faith in his client’s cause, and in himself.”
